近來我看到多個自媒體賬號在介紹下面這款可翻面章魚公仔在國外的熱銷情況,它甚至是Tiktok上的網(wǎng)紅產品:
我去到了亞馬遜美國站,看看它在上面的業(yè)績情況。目前它是亞馬遜美國站的#1 Best Seller,現(xiàn)有留評數(shù)4192,售價15美元:
經(jīng)檢索,它是存在有高度相關的美國外觀專利的,下面是美國外觀專利圖的截圖:
所以,在美國市場想銷售該款產品,務必注意潛在的專利侵權風險......
這里尤其提示玩具廠家,他們可能會想,我換一種動物形象,但是還是可以翻面的,是否可行?
不行!只要是類似翻面操作的毛絨玩具,在美國市場均有侵權風險......因為,它也有美國的發(fā)明專利(Abstract:The present disclosure includes embodiments directed to a reversible toy.
